Terms of Service

1. Acceptance

By using the Venturr app or website ("Service"), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service. Venturr is operated by Volundr Labs, LLC, based in Castle Rock, Colorado.

2. What Venturr Does

Venturr turns social media content (TikToks, Instagram posts, etc.) into trip itineraries using AI. Itineraries are suggestions — you are responsible for verifying details like business hours, availability, pricing, and safety before booking or visiting any location.

3. Your Account

• You must be at least 13 years old to use Venturr.
• You are responsible for keeping your account credentials secure.
• One account per person. Do not share or transfer your account.

4. Your Content

When you share links or content with Venturr, you grant us a limited license to process that content for the purpose of generating your itineraries. You retain ownership of any content you provide.

You agree not to share content that is illegal, harmful, or infringes on others' intellectual property rights.

5. AI-Generated Content

Itineraries and recommendations are generated by AI and may contain errors, outdated information, or inaccuracies. Venturr does not guarantee the accuracy, completeness, or safety of any AI-generated content. Always verify before acting on suggestions.

6. Acceptable Use

You agree not to:

• Use Venturr for any unlawful purpose
• Attempt to reverse-engineer, scrape, or abuse the Service
• Interfere with or disrupt the Service or its infrastructure
• Impersonate any person or entity
• Use automated tools to access the Service without permission

7. Intellectual Property

The Venturr name, logo, app design, and original content are owned by Volundr Labs, LLC. You may not copy, modify, or distribute any part of the Service without written permission.

8. Third-Party Content & Services

Venturr may reference or link to third-party businesses, locations, and services. We do not endorse, control, or assume responsibility for any third-party content, products, or services.

9. Disclaimer of Warranties

Venturr is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate.

10. Limitation of Liability

To the maximum extent permitted by law, Volundr Labs, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to damages from reliance on AI-generated itineraries.

11. Indemnification

You agree to indemnify and hold harmless Volundr Labs, LLC and its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Dispute Resolution

Any disputes arising from these Terms will be resolved through binding arbitration in Castle Rock, Colorado under AAA rules, except that either party may seek injunctive relief in court. You agree to resolve disputes on an individual basis and waive any right to participate in a class action.

You may opt out of arbitration within 30 days of first using the Service by emailing derek@venturr.app with "Arbitration Opt-Out" in the subject line.

If you are an EEA consumer, nothing in this section prevents you from bringing proceedings in the courts of your country of residence, and mandatory consumer protections of your home jurisdiction apply.

13. Termination

We may suspend or terminate your access to Venturr at any time, with or without cause. You may stop using the Service and delete your account at any time via Settings within the app. Upon termination, your right to use the Service ceases immediately.

14. Apple App Store

If you access Venturr through the Apple App Store, the following additional terms apply:

• These Terms are between you and Volundr Labs, LLC only, not Apple Inc.
• Volundr Labs, LLC, not Apple, is solely responsible for the Service and its content.
• Apple has no obligation to furnish any maintenance or support services for Venturr.
• In the event of any failure to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple has no other warranty obligation.
• Apple is not responsible for addressing any claims relating to the Service, including product liability, legal compliance, or intellectual property infringement.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

15. Changes to These Terms

We may update these terms from time to time. We'll notify you of material changes via email or in-app notice. Continued use after changes constitutes acceptance.

16. General

These terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Volundr Labs, LLC regarding Venturr. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect. We are not liable for delays or failures due to events beyond our reasonable control.
